Personal Data Protection Privacy Notice

As Kaşlıoğlu Law Firm, we are fulfilling our obligation to provide information in accordance with Article 10 of the Personal Data Protection Law No. 6698 ("KVKK"). Your personal data, the purposes for which your data is processed, the legal basis for processing, the categories of recipients to whom your data may be disclosed, the method of data collection, and your rights regarding your personal data are explained below.

  1. PROCESSING PURPOSES AND LEGAL BASIS OF YOUR PERSONAL DATA

1.1. Processing of Website Visitors' Personal Data

Personal data processed in this process: Transaction security information (IP address, traffic information, cookie records, browser information, device information, visit time and duration, click and navigation data)

Purposes of data processing: Personal data of website visitors;

  • To fulfill our obligations under the Law No. 5651 on the Regulation of Publications Made on the Internet and the Fight Against Crimes Committed Through Such Publications and related legislation
  • To ensure the operation of the website and maintain user sessions
  • Creation of visitor statistics
  • Remembering preferences and improving the user experience
  • Processing is carried out for the purpose of receiving requests submitted via the contact form.

Legal Basis for Data Processing and Data Collection Method: Your personal data is collected automatically through cookies and similar tracking technologies when you visit our website. Your personal data is processed based on the legal basis that the processing of personal data is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject, in accordance with Article 5/2 (f) of the KVKK.

1.2. Processing of Personal Data of Our Clients

Personal data processed in this process: Identity information (name, surname, Turkish ID number, date of birth, and information contained in the power of attorney), contact information (phone number, email address, address), personal information (position/title), professional experience information, financial information, legal transaction information (information contained in correspondence with judicial authorities, information processed during litigation and consultation processes), visual and audio recordings.

Purposes of data processing: The personal data of our clients or their employees or representatives;

  • The provision of legal advisory and litigation services and the fulfillment of legal obligations
  • Conducting, monitoring, and concluding litigation and advisory processes, and performing authorized transactions
  • The conclusion and performance of contracts
  • Conducting communication activities
  • Providing information to authorized public institutions and organizations.

Legal Basis for Data Processing and Data Collection Method: Your personal data is processed in accordance with Article 5/2 (c) of the KVKK, provided that it is directly related to the establishment or performance of a contract, and that the processing of personal data belonging to the parties to the contract is necessary, and in accordance with Article 5/2 (ç) The necessity of processing personal data for the data controller to fulfill its legal obligations, and KVKK Article 5/2 (e) for the establishment, exercise, or protection of a right, are the legal bases for processing personal data.

Your personal data is collected verbally, in writing, or electronically; via email, telephone, face-to-face meetings, court and application files, printed and electronic documents, letters from authorized institutions, website forms, and contracts.

1.3. Processing of Personal Data of Potential Clients

Personal data processed in this process: Identification information (name, surname), contact information (phone number, email address, address), personal information (position/title), legal transaction information (information from correspondence with judicial authorities, information processed during litigation and consultation processes),

Purposes of data processing:

  • Providing information about litigation and consultation processes, obtaining information within the scope of service requests
  • Conducting contract negotiations
  • Conclusion of contracts and conducting communication activities

Legal Basis for Data Processing and Data Collection Method: Your personal data is processed based on the legal basis that the processing of personal data belonging to the parties to the contract is necessary for the establishment of a contract, in accordance with Article 5/2 (c) of the KVKK.

Your personal data is collected verbally, in writing, or electronically; via email, telephone, face-to-face meetings, court and application files, printed and electronic documents, digital forms, and contracts.

1.4. Processing of Personal Data of Job Applicants
Personal data processed during this process:
Identity information (name, surname, date of birth, place of birth), contact information (phone number, email address, address), personal information (position/title), professional experience information (work history and details, education history and details)

Purposes of data processing: The personal data of job applicants are processed for the following purposes:

  • Conducting the application and interview processes for job candidates,
  • Conducting communication processes
  • Planning human resources processes, 
  • Conducting contract processes,
  • Conducting storage and archiving activities.

Legal Basis for Data Processing and Data Collection Methods: Your personal data is processed based on the legal basis that the processing of personal data belonging to the parties to the contract is necessary for the establishment of a contract, in accordance with Article 5/2 (c) of the KVKK.

Your personal data is collected through automatic or non-automatic means via your resume, email, website career page, or job interview.

1.5. Processing of Personal Data through Contact Form
Personal data processed in this process:
First name, last name, email address, communication subject, and personal data contained in the message content

Purposes of data processing: Personal data of individuals who fill out the contact form;

  • Conducting communication activities,
  • Tracking requests and applications,
  • Conducting an investigation regarding the subject of the request,
  • For use as evidence in future disputes;

Legal Basis for Data Processing and Data Collection Method: Your personal data is processed based on the legal grounds that data processing is necessary for the establishment, exercise, or protection of a right under KVKK Article 5/2 (e) and that data processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject under KVKK Article 5/2 (f). Your personal data is collected automatically through digital forms.

2. PERSONS TO WHOM YOUR PERSONAL DATA IS TRANSFERRED AND THE PURPOSES OF TRANSFER

Kaşlıoğlu Law Firm processes your personal data in accordance with the provisions of the Personal Data Protection Law regarding the transfer of personal data, in line with the principles of "need to know" and "need to use," while adhering to the principle of data minimization and taking the necessary technical and administrative security measures.

In this context, your personal data may be transferred to authorized public institutions and organizations in order to fulfill our legal obligations  in response to requests from authorities authorized to request your information under the legislation. 

Your personal data may also be transferred to business partners and suppliers with whom services are obtained or cooperation is carried out, for the purposes of receiving support in business processes and ensuring infrastructure and technical security.

In cases where your personal data is transferred abroad by Kaşlıoğlu Law Firm, in accordance with Article 9 of the KVKK and Article 9 of the Regulation on the Procedures and Principles Regarding the Transfer of Personal Data Abroad, "The provision of appropriate safeguards through a standard contract and your consent to the use of cookies, provided that one of the circumstances set forth in paragraph 6 of Article 9 of the KVKK exists" as one of the legal grounds, your personal data may be shared with our business partners, suppliers, and service providers.

      3. YOUR RIGHTS REGARDING THE PROTECTION OF YOUR PERSONAL DATA

We would like to inform you that you have the following rights under Article 11 of the KVKK:
• The right to learn whether your personal data has been processed,
• Request information regarding the processing of your personal data if it has been processed,
• To learn the purpose for which your personal data is processed and whether it is being used in accordance with that purpose,
• To know the third parties to whom your personal data has been transferred,
• To request the correction of your personal data if it has been processed inaccurately or incompletely, and to request that this be communicated to the third parties to whom your personal data has been transferred,
• Requesting the deletion or destruction of your personal data if the reasons for processing your personal data no longer exist, and requesting that this be communicated to third parties to whom your personal data has been transferred,
• Object to the outcome of the analysis of the information we have obtained through automated systems and request compensation if you suffer any damage.

4. CONTACT FOR YOUR RIGHTS AND REQUESTS

You may submit your questions regarding your personal data and your rights and requests under Article 11 of the KVKK by means of a petition prepared in accordance with the conditions specified in the Communiqué on the Procedures and Principles for Applying to the Data Controller, or by filling out the "Data Subject Application Form" available on our website using the email address registered in our system to the email address kvkk@kaslioglu.av.tr. Additionally, you may submit your request in writing to the Data Controller in accordance with the conditions specified in the "Regulations on the Procedures and Principles for Submitting Requests to the Data Controller" or using the "Data Subject Request Form" available on our website, or by submitting a written request in person or through a notary public to the following address: Caddebostan Mah. Funda Çıkmazı Sk. No:2-6 Sahil Apt. Floor: 1, Apartment: 1-2, Kadıköy/İstanbul. Data subjects who choose this method must submit documents proving their identity. 

As data subjects, if you submit requests regarding your rights to us, we will process your request free of charge within 30 (thirty) days at the latest. However, if the response to your request requires a cost in accordance with the legislation, we may request the fee determined by the Personal Data Protection Board.
